DIVISION 44’S POLICIES AND PROCEDURES

Division 44 will be updating it's WebEx Policy, effective Monday, October 3, 2022. ONLY PRETRIAL CONFERENCES, TEMPORARY CUSTODY HEARINGS, AND UNCONTESTED FINAL ADOPTION HEARINGS WILL BE HEARD VIRTUALLY BY DEFAULT.

All other Hearings, including Arraignments and Case Management Conferences, will now be set for in-person hearing. This includes all Adjudications, Dispositions, and Reviews. That being said, placement providers, parent aids, CASA volunteers, and paralegals/support staff may still attend in-person hearings virtually, so long as they are not to be called as witnesses to the hearing.

The Court will still entertain timely motions for virtual and telephonic appearance by parties and witness. Such motions, in addition to the basis for the relief, should always indicate whether or not any issue will be contested at the hearing, and whether or not all parties are in agreement with waiving the in-person appearance. THAT A MOTION FOR VIRTUAL APPEARANCE IS GRANTED FOR A PARTY OR WITNESS TO A HEARING WILL NOT MEAN THAT ALL PARTIES AND WITNESSES WILL AUTOMATICALLY BE PERMITTED TO APPEAR VIRTUALLY AS WELL.

If you are sick or have a positive COVID-19 test, or are otherwise physically unable to be present in the courtroom, but unable to file a timely motion, please email the Court as soon as possible for the link for virtual participation. When the case is called, the Court will then decide to either waive your physical presence or reset the matter, as appropriate.
